The first CLE program in a series of Philadelphia Bar Association CLE programs that Prepare You to Take Action!
Co-hosted by the Hosted by the Young Lawyers' Division, Immigration Law Committee, and American Immigration Lawyers Association (AILA)
This program provides the tools necessary to prepare to advocate for immigrant clients by laying out the essentials of filing federal court actions in immigration cases, focusing on the writ of habeas corpus and the writ of mandamus.
The panelists will provide an in-depth summary of the applicable law, the step-by-step processes involved in each court action, a discussion of pitfalls in the process, sample materials, and advice on where to turn for additional assistance. Mandamus petitions are filed in federal court when applications have been held up unjustifiably by USCIS. As we anticipate long delays with processing times at USCIS, learning how to file a mandamus petition will be extremely useful tool in seeking judicial review.
The panelists will also discuss procedural issues in filing these petitions in the Eastern District of Pennsylvania and issues with airport detention. The CLE will conclude with assistance on applying for admission to the Eastern District of Pennsylvania.
