TODAY - Intermediate Cross-Examination

CLE_Cross-Exam Series Pt2: Intermediate Cross-Examination

Hosted by the State Civil Litigation Section

A crucial skill for all litigators is the ability to highlight the weaknesses in an opponent's case through cross-examination. This series of CLE programs developed and presented by the Honorable Mark I. Bernstein (Ret.) and Larry Bendesky, superb trial lawyer from Saltz Mongeluzzi Barrett & Bendesky, among other skilled trial lawyers, will explore how to exercise essential legal, tactical and verbal skills to present an effective and successful cross-examination.

Learn, among other tools and techniques, where your preparation should begin, strategies for preparation, when NOT to cross examine, how to develop facts that help your case, tips for keeping control of the witness, effective use of documents/evidence and deposition, the use of tone and body language and use of technology.

In this series of CLE programs, attendees will learn fundamentals for a novice attorney executing their first cross-examination, as well as approaches for the most skillful attorneys dealing with a difficult witness. Panelists will offer guidance on the necessary structure and tools to create effective and impactful cross-examinations.

Intermediate Cross-examination is Part II of this CLE series.

You've now presented a few cross examinations and you have the opportunity to cross a serious expert witness. But, OMG, this witness has testified in more courtrooms than years you've been alive… how do you approach and succeed with a "professional" witness?

  • How do you prepare?
  • What are some general principles?
  • What is an "expert?" What should I really know about the expert?
  • How do I formulate effective yet damning questions that get results?

Panelists will discuss strategic considerations surrounding expert cross-examination, and will provide specific practical tips to guide practitioners.

Attend one or all of the CLE programs in this series to make your first or next cross-examination the most effective cross-examination you’ve given yet.
