The protections of Title VII's prohibition of sex discrimination as forbidding any employment discrimination based on gender identity or sexual orientation should apply regardless of any state or local laws.
This course will examine recent developments in employment protections for members of the LGBT community, and whether such developments will withstand appellate and legislative challenges. The course will also explore the historical evolution and consideration of sexual orientation as a protected class, and the trending direction of protections both legislatively and judicially.
Practice tips from both plaintiffs and defense perspectives will be discussed.
