Litigation Lessons from the VW Emissions Scandal: Privilege, Litigation Holds, and Lawyer Liability

CLE_Litigation Lessons From the VW Emissions Scandal

Thank you, the APRIL 17th date HAS BEEN FILLED for this FREE CLE for Philadelphia Bar Association members in good standing.

Hosted by the Professional Responsibility Committee, the Business Law Section's Business Litigation Committee and the Young Lawyers Division

What ethics and practical lessons can be learned from this case?

The Volkswagen emissions cheating scandal went as far as the in-house legal department. The pitfalls encountered by counsel there confront all litigators. Using the VW case as a starting point, experienced panelists in professional responsibility, e-discovery and corporate litigation will provide insight into best practices regarding ethical and practical issues confronting litigators today.

The following topics will be addressed:

  • Rules of Professional Conduct 3.3, 3.4, 5.1, 5.2, 1.13 -- access to potential evidence, duty of candor, duty to supervise, representing the organizational client, as well as, prohibiting unlawful document destruction
  • Best practices combining zealous advocacy and compliance with all ethical and legal requirements in discovery
  • Treatment of potential evidence/Spoliation -- document/ evidence holds, social media
  • Whose privilege is it? -- representing an ‘organization’ as client
