TOMORROW - Reaching Reasonable Resolutions in the Absence of Impairment Rating Caps

CLE - WC_Reaching Reasonable Resolutions

Hosted by the Workers' Compensation Section

Prior to Protz II, the change of a claimant’s benefits from total to partial in character, under an impairment rating evaluation, was an effective tool in beginning settlement talks. The 500 week clock initiated by the impairment rating process put a value on the possible wage exposure for more serious claims when it appeared unlikely that a claimant would return to work or recover. While the impairment rating process going forward is no longer a viable option for capping a claimant's benefits, other methods exist that can be used to bring both parties to the settlement table and prevent years of litigation.

In this CLE presentation, panelist will explore these methods and how they can be used to reach reasonable resolutions for both sides.

Please join your colleagues in the Workers' Compensation Section for this examination into the impairment rating process after Protz II.
