This CLE program will actually explain risk transfer provisions in construction contracts so that you can effectively protect your construction-related clients.
Due to the inherent risk in construction projects, contractual risk transfer provisions are important whether you represent owners/developers, contractors or subcontractors. Too many practitioners do not understand the importance or meaning of standard insurance requirements in construction contracts, or what constitutes an enforceable indemnification provision. As a result, they rely on form contracts that contain indemnification and insurance provisions that are out-of-date or were poorly drafted in the first place.
Hear a practical and entertaining overview of indemnification provisions and insurance requirements in construction contracts so that you can better protect your clients. Featured speaker, Jonathan Cass, will use his superior intellect, charm and handsome good looks to translate risk transfer provisions that appear to be incomprehensible gobbledygook into something akin to English.
This presentation will include:
- A discussion of the importance of indemnification provisions and how to draft them so that they are enforceable
- An analysis of different indemnification provisions including the standard AIA provisions, and an exemplar provision from a major general contractor
- Explanations of the insurance requirements that you should be including in your contracts, and what the requirements actually means in plain English
- The necessity of builders' risk insurance during construction and what it does and does not cover

CLE - "I Know What You Did Last Weekend"-Social Media in WC Aug. 12
Hosted by the Workers' Compensation Section
This CLE program addresses effective use of social medical in workers' compensation cases. The program will highlight dilemmas faced by attorneys and clients, including: counsel's knowledge of a client removing content off a social media page; "friending" clients and witnesses; investigation techniques using social media; and using social media sites at trial.
Experienced faculty will examine:
- The rules of evidence
- How to discover social media information
- How to admit it into evidence from both a defense and claimant perspective
- Recent case law
- New investigation techniques regarding social media
Attendees will gain with a better understanding of the do's and don'ts of social media as it relates to litigating a workers' compensation case.

In the first hour, attendees will examine entertainment fee agreements using a sample hourly rate agreement and a contingent fee agreement. The featured speaker, entertainment lawyer, Bernie Resnick, will discuss the ethical requirements of fee agreements, with a focus on attorney’s fees in the sports and entertainment industry.
In the second hour, Resnick will lead a discussion of ethics issues that attorneys typically encounter in the sports and entertainment industry, highlighting Pennsylvania Disciplinary Rules 1.5, 1.7 and 1.8.
