Starting, Building Successful Law Firms March 17

Alan M. Feldman started his own law firm in 1987 with just a few files in a subletted office. Together with Carol Nelson Shepherd and Ezra Wohlgelernter, he presided over the firm's development into one of the region's premier personal injury boutiques. On Monday, March 17, Alan and Carol will share their thoughts on what it takes to create a successful law practice, and will answer questions from lawyers who have made, or are considering, the jump from employee to owner-operator of your own firm.

Created in 2014 by Chancellor William P. Fedullo, the Law Firm Laboratory is a free program series and ongoing incubator of innovative ideas, strategies and concepts for starting and nurturing new law firms and helping existing law firms of all types serve the changing needs of tomorrow's clients.

April 3 Chancellor's Forum: Access to Justice Initiative

Chancellor William P. Fedullo invites you to a Thursday, April 3 Chancellor’s Forum featuring Deborah Leff, Acting Senior Counselor of the U. S. Department of Justice Access to Justice Initiative, about the access to justice crisis in the criminal and civil justice system.

Additional panelists include Chancellor William P. Fedullo, Catherine C. Carr, Executive Director of Community Legal Services and Kevin V. Mincey of Mincey & Fitzpatrick, LLC. The moderator for the program is Su Ming Yeh, chair of the Public Interest Section.

The Access to Justice Initiative works within the Department of Justice, across federal agencies, and with state, local, and tribal justice system stakeholders to increase access to counsel and legal assistance and to improve the justice delivery systems that serve people who are unable to afford lawyers. Created only four years ago, the Initiative can already report significant accomplishments in supporting indigent defense, strengthening juvenile justice systems, expanding access to counsel in high-stakes civil proceedings, increasing resources for civil legal aid, and more.

The Chancellor’s Forum begins at 4 p.m. in the 11th floor Conference Center at the Philadelphia Bar Association, 1101 Market St. A wine and cheese reception follows the program at 5 p.m. The reception is sponsored by U.S. Legal Support.

Jazz and Rainmaking with Steve Goodman March 13

The Business Law Section of the Philadelphia Bar Association is pleased to announce an evening of jazz and rainmaking on Thursday, March 13 with Steve Goodman, renowned jazz pianist and senior partner and major rainmaker at Morgan Lewis & Bockius LLP. Steve will provide insights to client development, retention and growth in an interview format with Karl Stark, Health and Science Editor and Jazz Reviewer for The Philadelphia Inquirer, and then will be joined on stage by the other members of the Goodman Trio, bass player Bruce Kaminsky and drummer Bruce Klauber, to complete the evening.

The evening runs from 5:30 to 7 p.m. at Chris' Jazz Cafe, 1421 Sansom St. Admission is complimentary for law student members of the Philadelphia Bar Association; $10 for Association members; and $20 for non-members. N.J. Insurance Commissioner to Speak March 14

Kenneth E. Kobylowski, New Jersey Commissioner of Banking and Insurance, will be the guest speaker at the Friday, March 14 meeting of the Committee on Insurance Practice.

New Jersey Gov. Chris Christie nominated Kobylowski to serve as Commissioner of Banking and Insurance on Jan. 30, 2012. He joined the Department of Banking and Insurance as Chief of Staff in February 2010 and took on the additional role of Acting Director of Banking in October 2011.

He served as the Chief Operating Officer for the Department with full responsibility for all legislative, regulatory, operational and administrative matters and also served as the Department’s liaison with other State departments and federal agencies, notably the Federal Reserve and the FDIC.

Prior to joining the Department, Kobylowski was in private practice for 20 years, beginning at Connell, Foley & Geiser in Roseland, N.J. and then moving to Herrick, Feinstein LLP, first in its New York City office and then in its Newark, N.J. office. He represented banks, insurance companies, lenders, developers and public and private entities. He is a magna cum laude graduate of Seton Hall University and a cum laude graduate of New York Law School.

Eisenhower Fellow on Experiences Abroad March 14

Neil Boyden Tanner will share his perspective on a career practicing international law, both in private practice and in-house and share stories of his experiences as a 2013 Eisenhower Fellow, for which he spent time in Brazil, Singapore and Vietnam at the Friday, March 14 meeting of the International Law Committee.

While on his fellowship, Tanner looked at what these countries were doing to attract foreign direct investment, to learn how the Philadelphia region could better attract foreign companies, created a website about his experience, and blogged. The meeting begins at 12 p.m. at Pepper Hamilton LLP, 3000 Two Logan Square, 18th and Arch streets.

Deadline for U.S. Supreme Court Admission is March 17

The Philadelphia Bar Association will move up to 50 of its members for admission to the Bar of the U.S. Supreme Court on Monday, May 5. The admission ceremony will be made to the full court sitting in Washington, D.C.

The court's requirements for a group admission ceremony are very comprehensive. To review these requirements and to download the forms for admission please visit the Supreme Court's web site at Select the Bar Admissions tab on the left-hand side and this will bring you to the link for the Bar Admissions Form and Bar Admissions Instructions. Please read the instructions carefully. Once you have determined if you are eligible for admission, please print out and complete the Admission Form. The instructions and guidelines are very specific and must be followed scrupulously. Do not fold the application or use staples. Use paper clips only.

Once you have successfully completed the Admission Form, please mail it along with a check made payable to the Philadelphia Bar Association. The cost to attend the ceremony is $225 for members of the Philadelphia Bar Association which includes your application fee and a continental breakfast. Please include an additional $25 if you are an Association member and plan to bring a guest. If you are not a member of the Philadelphia Bar Association, the fee is $325. Per the Supreme Court's rule, each inductee is permitted to bring only one guest. PLAN to Honor Bar's Zebe March 18

Merril L. Zebe, Public Interest Coordinator for the Philadelphia Bar Association, will be honored by the Pennsylvania Legal Aid Network (PLAN) at its 2014 Excellence Awards Dinner on Tuesday, March 18 at the Harrisburg Hilton & Towers.

Zebe is among a variety of civil legal aid professionals and friends of civil legal aid across Pennsylvania who are being recognized for their efforts in support of the clients served by the civil legal programs of the Pennsylvania Legal Aid Network.

Zebe joined the Philadelphia Bar Association staff in 2003. She received a B.S.W. degree from Temple University in 1976 and a J.D. degree from the University of Santa Clara Law School in 1980. She is an experienced public interest attorney and worked as a legal advocate with Community Legal Services Society, Inc., in Wilmington, Del., for 13 years. Zebe also served as a Director of Development for several nonprofit social services agencies in the greater Delaware Valley area.

One of Zebe's primary responsibilities is to provide staff support for the Association's Delivery of Legal Services Committee (DLSC), a committee composed of executive directors from over thirty nonprofit public interest law firms as well as law school representatives, leaders of the Bar Association and the private bar, law firm pro bono coordinators, judges and foundation directors that meet monthly to leverage their abilities to provide legal services and advocacy for low-income and other disadvantaged and under-served populations in Philadelphia. Additionally, she provides staff support and assistance to the Philadelphia Bar Association's Civil Gideon and Access to Justice Task Force. Zebe also staffs the "Civil Legal Justice Coalition," a statewide coalition co-chaired by representatives from the Philadelphia Bar Association, Pennsylvania Bar Association and Allegheny Bar Association. The honorary chair of the Coalition is Chief Justice Ronald D. Castille. Coalition members include statewide stakeholders and many public interest and private firm leaders committed to improving access to justice in Pennsylvania.

Deadline for Bench-Bar CLE Proposals is March 21

The deadline for proposals for continuing legal education courses for the Bench-Bar & Annual Conference at Borgata in Atlantic City, N.J. is Friday, March 21. Proposals should include a brief description of the program and identify the course planner and proposed panelists. Composition of the panels should reflect the diversity within our legal community and when appropriate, include members of the judiciary. The Bench-Bar & Annual Conference is set for Friday and Saturday, Oct. 17-18.

Please note that a representative of a company that could potentially be a sponsor of the Bench-Bar & Annual Conference is not permitted to serve as a panelist. Programs should be one hour long, with no more than four panelists. A program may have one moderator in addition to the panelists. Decisions regarding the programs selected will be made by Friday, April 4. The Bench-Bar Committee will have final approval on the selected panelists.

Donate Gently Worn Shoes, Handbags to Dress for Success

Every spring, the Philadelphia Bar Association Women in the Profession Committee Public Service Task Force hosts a shoe drive to provide donations for Dress for Success, which provides professional attire and career counseling to low-income women in Philadelphia. This year, we will be collecting gently worn interview-appropriate shoes or handbags at the Tuesday, March 25 Women in the Profession meeting and at a networking happy hour on Thursday, March 27 at Tir Na Nog, 1600 Arch St., from 6 to 8 p.m.

Marketing the Nonprofit as a Volunteer March 31

As volunteers and members of boards, your duties include helping nonprofits to spread the word about their cause and meet their financial objectives. Marketing the nonprofit comes in many forms, from obtaining sponsorships and donations to recruiting volunteers and event attendees.

O'Connor Award Nomination Deadline is April 2

The Women in the Profession Committee is seeking nominations for the 2014 Sandra Day O'Connor Award. Deadline for nominations is Wednesday, April 2.

The award is conferred annually on a woman attorney who has demonstrated superior legal talent, achieved significant legal accomplishments and has furthered the advancement of women in both the profession and the community.

The committee established the award in 1993 to recognize the important contributions that women attorneys in Philadelphia have made to the legal profession. That year, U.S. Supreme Court Justice Sandra Day O’Connor presented the first award to U.S. District Court Senior Judge Norma L. Shapiro. The award has since been presented to the late Juanita Kidd Stout, former justice of the Pennsylvania Supreme Court; Deborah R. Willig, first woman Chancellor of the Philadelphia Bar Association; Professor Marina Angel, of the Temple University Beasley School of Law faculty; Third Circuit Court of Appeals Judge Dolores K. Judge Martin Burman Memorial Luncheon April 4

Please join the Workers' Compensation Section to Honor and Remember the Life of Judge Martin Burman on Friday, April 4. This luncheon will be held in lieu of our monthly CLE Program.

IRS IDR, Summons Policy CLE April 10

Join the Tax Section for the CLE program "What Happened to the Kinder, Friendlier IRS:
IRS Flexing its Muscles with New IDR and Summons Policy" on Thursday, April 10.

This CLE program will address the new Information Document Request and Summons policy for taxpayers. Under the policy, taxpayers who fail to meet IRS deadlines for providing information will be issued pre-summons letters, and if they fail to respond, will be issued summonses for delinquent information. The new directive constitutes a significant change in the examination process.

Updated Guide to LGBT Benefits April 23

Employers, employees and unions can often feel at sea amid the various court rulings, statutes and executive actions affecting LGBT employees' spousal and other benefits - particularly in the wake of the Supreme Court's recent recognition of (some) same-sex marriage rights in United States v. Windsor.

The Wednesday, April 23 CLE "Your Employee's 'New' Family: An Updated Guide to LGBT Employee Benefits, including Family Leave, Health, Retirement, Taxes and Visas" will bring practitioners up to date with the latest law on same-sex partnerships and LGBT employees' rights as they relate to payroll and income taxes, health benefits, family leave, retirement plans, and non-citizen spouses. William Clark at Giants of the Business Bar April 23

The Business Law Section will feature William H. Clark Jr. at its Second Annual Giants of the Business Bar on Wednesday, April 23.

This event is part of a series of programs in which the Business Law Section recognizes legal giants who have had a significant impact on the practice of business law in Philadelphia and beyond.

While Clark is best known for his work writing the Pennsylvania business corporation and other entity laws, the discussion will include his activities in a number of other areas.

He drafted and directed the successful lobbying effort for the North Dakota Publicly Traded Corporations Act on behalf of a coalition of activist investors led by Carl Icahn. The North Dakota statute is the first shareholder-friendly corporation law in the country, and the discussion of this topic will include consideration of the current state of public company corporate governance.

He serves as reporter for the Model Nonprofit Corporation Act. Following on the theme of the previous topic, this discussion will include consideration of the current state of nonprofit governance.

He was the reporter for a uniform law regarding disclosure of the beneficial owners of business entities. Preparation of this statute was in response to an on-going effort both nationally and internationally to involve lawyers in fighting money laundering and terrorist financing. Developments in this area over the next few years are likely to affect every lawyer, regardless of area of practice.

He drafted the Model Benefit Corporation Legislation and is spearheading its adoption around the country. To date 20 jurisdictions including Pennsylvania have authorized benefit corporations. Benefit corporations pursue a "triple bottom line" of positive results for profits, people and the planet. The ultimate goal of this effort is to move the economy generally to what Clark describes as a system of "shared and durable prosperity."

Applicants Sought for FJD Judicial Fellowship Program

Philadelphia judges are seeking to host law school graduates as judicial fellows to provide the graduates with substantive legal experience while benefitting the court system with additional legal talent, as part of the First Judicial District's Judicial Fellowship Program. Now entering its fourth year, the Judicial Fellowship Program was created in 2011 to address the difficult hiring climate for lawyers that many recent law graduates were facing.

The Judicial Fellowship Program aims to provide high-caliber law graduates with substantive experience in the law, and to support the Court in carrying out key functions. Fellows volunteer their time, have the same responsibilities as regular paid judicial law clerks, and gain the benefit of training by judges in the Philadelphia courts. Judicial fellows' service helps our high-volume court system maintain its superior quality of service to the Philadelphia community. Judges help judicial fellows by mentoring and providing legal experience that will enhance their competitiveness for paid employment as new lawyers.

Philadelphia Court of Common Pleas Judge Lisa M. Rau developed the program with help from Professor Chapin Cimino of the Drexel University School of Law as well as faculty and administrators from career services offices at the University of Pennsylvania's Law School and Temple's Beasley School of Law. The Judicial Fellowship Program quickly expanded and now welcomes graduates from law schools from across the country. The Philadelphia Bar Association is a supporter of the Judicial Fellowship Program.

The application process is streamlined and selective. Prospective judicial fellows apply directly via email to judges with whom they are interest in working. Judges select judicial fellows from those applicants who apply to them directly. The list of judges with available positions for judicial fellows is provided on the Judicial Fellowship Program's website. Each judge and fellow team designs a flexible schedule (minimum of 20 hours per week) that ensures reliable service to the judge but permits the fellow to seek a paid position elsewhere. Judicial fellows do not commit to any length of service enabling them to leave the fellowship with two weeks' notice to their judge upon obtaining paid employment.

During the first three years of the program, more than 50 judges volunteered to host judicial fellows and the Court hosted 149 judicial fellows from 30 different law schools. As of February 2014, the vast majority of judicial fellows (approximately 84 percent) who left their fellowship departed for paid jobs using their legal skills.

Women's Wit and Wisdom May 5

Join leaders from Philadelphia and across the country when Vision 2020 honors ABA Past President Laurel Bellows at its "Women's Wit and Wisdom Luncheon" on Monday, May 5 at 12 p.m. at the Hyatt at The Bellevue, Broad and Walnut streets. Civil Gideon Essay Contest Honors Ken Shear

In honor of the retirement of Kenneth Shear, who served as executive director of the Philadelphia Bar Association for 37 years, the "Kenneth Shear Civil Gideon Legal Justice Essay Competition and Scholarship Fund" has been established by the Association and the Philadelphia Bar Foundation to honor Shear's contributions to the Philadelphia legal community.

To raise an endowment to support the Essay Competition and Scholarship Fund, Immediate-Past Chancellor Kathleen D. Wilkinson and Bar Foundation President Deborah Gross are donating seed money to begin the funding of the Essay Competition and the Scholarship Fund in order to award at least one scholarship in 2014. The announcement of the scholarship was made by Wilkinson and Gross at the December Board of Governors meeting.

The purpose of the Essay Competition is to award a scholarship of $1,500 annually to a second- or third-year law student from the Philadelphia area law schools who writes the best short essay on the subject of Civil Gideon. The student must be willing to serve as an intern for 40 hours, pro bono, to assist the Philadelphia Bar Association and Philadelphia Bar Foundation with its endeavors through the Philadelphia Bar Association Civil Gideon Task Force, the statewide Access to Civil Justice Coalition and/or future statewide Access to Civil Justice Commission and/or will serve on another pro bono project of the Philadelphia Bar Association and Philadelphia Bar Foundation, which project is dedicated toward equal justice for all and fulfills the purposes of advancing civil Gideon, public education in the Philadelphia School District, and/or service to the poor.

The essay must be no longer than 10 pages or 2,500 words, whichever is shorter. The 2,500-word limitation refers to the text of the submission; footnotes may be a maximum of 1,000 words (in addition to the 2,500 word maximum for text). Endnotes are not permitted.

The essay must be in seminar paper or law journal article format only; submissions in the form of a memorandum, brief, judicial opinion or other type of legal document are not acceptable. The essay may not be previously published or currently accepted for publication in any publication other than in connection with this competition. The complete rules are available at

NJ Attorney Online Registration Center Available

The Attorney Online Registration and Payment Center is now available for licensed New Jersey attorneys for the 2014 registration/payment cycle through the Judiciary's web-based application at Pursuant to Rules 1:20-l(b) and (c), 1:28-2(a), 1:28B-l(e), and 1:42-2(b), attorneys licensed to practice in New Jersey are required annually to file a registration statement in a form prescribed by the Administrative Director of the Courts with approval of the Supreme Court and to pay an assessment in an amount determined by the Supreme Court.

The 2014 deadline for registration and payment is March 28, 2014. Attorneys are encouraged to register online and pay any required fees electronically. To assist with the registration process, an electronic notice about the web-based application has been emailed to each attorney who previously registered online. For attorneys who are not currently enrolled in the electronic registration system, a User ID and temporary password will be mailed to each such attorney's billing address to facilitate a transition to use of the online process. In addition to the annual registration requirement, attorneys maintaining a plenary or limited license to practice law in New Jersey must certify to the completion of their continuing legal education (CLE) requirements in accordance with Rule 1:42. A noncompliance fee of $50 will be assessed against attorneys who report that they failed to complete the requisite CLE credits by the deadline for course completion. An additional $50 (for a total of$100) will be assessed against attorneys who fail to complete their required CLE credits within the grace period provided by BCLE Reg. 402:1 and against attorneys who fail to report regarding CLE compliance at all.

Beginning in 2014, attorneys who are noncompliant with the mandatory CLE requirement are subject to being declared administratively ineligible to practice law in New Jersey. A declaration of administrative ineligibility will include noncompliant attorneys who are to report compliance in 2014 (Group 1) and also those from either Group 1 or Group 2 who remain noncompliant from any prior compliance period. To be removed from the CLE ineligible list and restored to active status, the noncompliant attorney must satisfy all outstanding CLE credit requirements and pay any required fees. The CLE credit requirement will stack; i.e., the attorney must make up CLE credits for all compliance periods that the attorney is noncompliant.
